General Terms and Conditions of Business (Ts & Cs)

1. Booking confirmation and payment
Upon booking, the tenant shall receive a message about the reserved booking period. For a firm confirmation of your booking, we require a payment of 25% of the total cost of your stay by bank transfer.

2. Arrival/handover of the apartment
You can move into your apartment from 1 p.m. on the first day of your stay. You do not have to tell us what time you are coming if you plan to arrive up to 5 p.m. (Monday to Friday). If you are arriving after 5 p.m., on weekends or bank holidays, you must book a time for the handover of your apartment.

3. Cancellation
We will hold cancellation fees of 25% of the total cost of your stay if you do not turn up.

4. Deposit for long-term lets of more than one month
To cover us in the event of any damage and in order to secure all claims of the landlord arising from the booking/rental agreement, a deposit of €1000 (in words: one thousand euros) must be paid in respect of the apartments in the event of long-term lets of more than one month no later than when you collect your key. The deposit will be returned within seven days of the end of your stay/booking to an account appointed by the tenant, unless it has to be used.

5. Temporary use/careful use of the apartment
The tenant rents the apartments for temporary use. Subletting or other transfer of the use of the apartment to third parties other than those named in the contract/booking confirmation is permitted only with the written agreement of the landlord. Pets are not allowed. Both apartments are non-smoking apartments. In the event of smoking in the apartment, an extra cleaning charge of at least €300.00 will be charged so that the next occupant can enjoy a pleasant environment. Upon handover, the tenant will be given a general key (to the apartment, electric shutters and garage door), which must be returned to the landlord upon departure/at the end of the rental period.

6. Maintenance of the rental property
If, during the course of your stay, there is any damage to the property, the tenant must immediately inform the landlord of this. The tenant must treat the apartment with care. The tenant is liable to the landlord for any damage caused by breaches of the duties of care and of notification upon him, in particular also if the premises are insufficiently aired, cleaned, heated or insufficiently protected from frost. The inventory must not be removed.

7. Internet
Free high-speed Internet access via LAN is included in the rental price. The tenant must ensure that the Internet is used only in the framework of what is legally permissible.

8. Access to the property by the landlord
The landlord and/or his representative may enter the property for good reason after giving prior notice.

9. Return at end of rental period
At the end of the rental period, the apartment must be handed back no later than 11 a.m. In the event that the apartment is not handed back in proper condition by the above-mentioned time, a daily charge of €95.00 is payable. The tenant must compensate the landlord for all damage in and to the apartment, if the tenant was responsible for this damage. The tenant must make adequate financial compensation for any inventory items damaged or stolen during the course of the stay, if the tenant was responsible for this damage. An inventory list is kept in each apartment (the inventory price list can be consulted at any time upon request).
If you need to leave outside of the agency's opening hours, please proceed as follows:
- close all windows
- switch off all electrical appliances, with the exception of the refrigerator
- return all apartment keys to the agency (directly opposite the apartment) or put the keys through the agency's letterbox
- close the apartment doors from outside

10. Severability clause
In the event that any of the provisions of this contract prove ineffective, the effectiveness of the remaining provisions shall be unaffected. A regulation which most closely resembles the ineffective regulation in economic and legal terms shall replace the ineffective regulation.

11. Court of jurisdiction and applicable law
Cologne is agreed as court of jurisdiction as long as the provisions of § 38 of the German Code of Civil Procedure (ZPO) apply to the parties to the contract. In the event of disputes with legal persons from foreign countries outside the EU, EuGVVO Art. 22 no.1 shall also apply. German law alone is applicable.
